Welcome to Brandit AI (“Brandit”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Brandit AI platform, websites, and design-generation services (collectively, the “Service”). By creating an account, clicking “Sign up”, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. The Service
Brandit AI provides artificial-intelligence tools that help you create marketing and branding materials, including logos, flyers, business cards, invoices, presentations, weekly social content, product and social reels, photo enhancements, and complete websites via the AI Website Builder. Outputs are generated automatically based on the information and prompts you provide and may vary in quality and accuracy.
2. Eligibility & Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account.
3. Credits, Pricing & Payments
Certain features consume credits. New accounts may receive complimentary credits, and additional credits may be purchased through our third-party payment providers. Prices, package sizes, and credit costs are shown at the point of purchase and may change at any time. Except where required by law, purchased credits are non-refundable and have no cash value. You are responsible for any taxes associated with your purchases.
3A. Subscriptions & Auto-Renewal
We offer optional subscription plans that grant a recurring allocation of credits each billing cycle (for example, monthly or annual). Subscriptions are billed through our payment processor, Paystack, using the payment method you authorise at checkout. By subscribing, you authorise us and Paystack to charge that method automatically at the start of each cycle until the subscription is cancelled. Subscription credit allocations, prices, and billing intervals are shown before you subscribe and may change on renewal with notice where required. You may cancel auto-renewal at any time from your account’s subscription section; cancellation stops future renewals but does not retroactively refund the current cycle, and you keep access and any allocated credits for the remainder of the cycle already paid for. We may also deactivate or decline to renew a subscription where necessary to protect the Service, to comply with our payment processor’s requirements, or where a payment fails. Except where required by law, subscription payments are non-refundable.
4. Referral Program
If you participate in the referral program, rewards accrue only when referred users meet the qualifying conditions we publish (which may include making a purchase). Generation-based earnings from a referred user are limited to the first three (3) months after that user signs up with your referral code; after this three-month window, their activity no longer generates referral earnings for you, although it may still be counted for statistics. We may modify, suspend, or end the program, adjust reward rates or the earning window, or withhold rewards we reasonably believe were obtained through fraud or abuse.
5. Your Content
You retain ownership of the content you upload (such as logos, photos, and business details). By uploading it, you grant Brandit a limited, worldwide, royalty-free license to process and use that content solely to operate and provide the Service to you. You represent that you have the rights to all content you submit and that it does not infringe the rights of others.
6. Generated Designs
Subject to your compliance with these Terms and payment of any applicable credits, you may use the designs you generate for personal and commercial purposes. AI outputs are not guaranteed to be unique, and similar results may be produced for other users. You are responsible for reviewing each design before use and for ensuring it does not infringe any trademark, copyright, or other right before relying on it commercially.
Designs produced through free or guest generations (that is, without an account or without using credits) may include a “Built by Brandit AI” watermark or attribution on the final exported file. This watermark is part of the free output and appears on the design you download. To obtain designs without the watermark, you can create an account and generate using credits or a subscription.
6A. AI Website Builder
The AI Website Builder generates a self-contained website (typically a single HTML file with embedded styles and scripts) from the information, brief, and any assets you provide. Subject to your compliance with these Terms and payment of any applicable credits, you own and may use, host, modify, and distribute the website files you generate for personal and commercial purposes, and you may download them as a ZIP package that includes deployment guidance. Brandit does not host, publish, maintain, or guarantee the uptime of any generated website; hosting and going live are your responsibility, and any third-party hosting, domain, or deployment services you use are subject to their own terms. Generated websites are provided “as is”: we do not warrant that they are error-free, secure, accessible, legally compliant, or fit for a particular purpose, and you are responsible for reviewing, testing, and adapting the site — including any copy, images, links, forms, and structured data — before publishing or relying on it. You are responsible for ensuring the generated site and any content or assets you include do not infringe the rights of others.
7. Acceptable Use
You agree not to use the Service to create or distribute content that is unlawful, infringing, deceptive, hateful, harassing, sexually explicit involving minors, or otherwise harmful; to reverse-engineer or disrupt the Service; to resell or misrepresent the Service; or to violate any applicable law. We may suspend or remove content or accounts that breach these rules.
8. Third-Party Services
The Service relies on third parties, including AI model providers and payment processors. Your use of those features may also be subject to the third party’s terms, and we are not responsible for their acts or omissions.
9. Privacy
We process personal data as described in our Privacy Policy. By using the Service you consent to that processing. We take reasonable measures to protect your data but cannot guarantee absolute security.
10. Intellectual Property
The Brandit AI platform, software, branding, and all related intellectual property are owned by Brandit or its licensors and are protected by law. These Terms do not grant you any rights in our intellectual property except as expressly stated.
11. Disclaimers
The Service and all generated outputs are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability.
12. Limitation of Liability
To the maximum extent permitted by law, Brandit shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill. Our total liability for any claim relating to the Service shall not exceed the amount you paid to us in the three (3) months preceding the claim.
13. Indemnification
You agree to indemnify and hold Brandit harmless from any claims, damages, or expenses arising out of your content, your use of generated designs, or your breach of these Terms.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or where necessary to protect the Service or other users. Sections that by their nature should survive termination will continue to apply.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above, and your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
